國際運輸總條件(中英文)

1 定義

《河北航空有限公司旅客、行李國際運輸總條件》(以下簡稱“條件”)中的下列用語,除具體條款中有其他要求或另有明確規定外,含義如下:

1.1 “公約”是指根據合同約定,適用于該項運輸的下列文件。

a)1929年10月12日在華沙簽訂的《統一國際航空運輸某些規則的公約》(以下簡稱“華沙公約”)。

b)1955年9月28日在海牙簽訂的《修改1929年10月12日在華沙簽訂的統一國際航空運輸某些規則的公約的議定書》(以下簡稱“海牙議定書”)。

c)1999年5月28日在蒙特利爾簽訂的《統一國際航空運輸某些規則的公約》(以下簡稱“蒙特利爾公約”)。

1.2 “國際運輸”指根據旅客運輸合同,其出發地點、約定經停地點和目的地點中有一個或一個以上的地點不在中華人民共和國境內的航空運輸。

1.3 “承運人”指包括填開客票的航空承運人和承運或約定承運該客票所列旅客及其行李的所有航空承運人。

1.4 “河北航”是指河北航空有限公司的簡稱(英文名稱:HEBEI AIRLINES,國際航空運輸協會IATA成員代碼:NS,國際民用航空組織ICAO指定代碼:HBH,國際航空運輸協會IATA結算代碼:836,企業地址:石家莊市中山東路303號,網站:www.01772767.com。

1.5 “河北航規定”指除本條件外,河北航為對旅客及其行李的運輸進行管理,依法制定、公布的并于填開客票之日起有效的規定,包括適用的票價。

1.6 “河北航授權代理人”指被河北航指定并代表河北航,為其航班并經授權后為其他航空承運人的航班銷售航空旅客運輸的銷售代理人。

1.7 “旅客”指除機組成員以外經承運人同意在航空器上載運或已經載運的任何人。

1.8 “客票”指由承運人或代表承運人填開的被稱為“客票及行李票”的憑證,包括運輸合同條件、聲明、乘機聯和旅客聯。

1.9 “連續客票”指填開給旅客與另一本客票連在一起,共同構成一個單一運輸合同的客票。

1.10 “乘機聯”指客票中標明“運輸有效”并列明指定地點間運輸旅客的部分。

1.11 “旅客聯”或“旅客收據”指客票中標明“旅客聯”或“旅客收據”并始終由旅客持有的部分。

1.12 “日”指日歷日,包括一周的7日。但發通知時,通知發出日不計算在內;確定客票有效期時,客票填開日和航班飛行開始日均不計算在內。

1.13 “全票價”指在票價適用期間商務、經濟各艙位等級銷售票價中最高的票價。

1.14 “折扣票價”指不屬于全票價的其他票價。

1.15 “行李”指旅客在旅行中為了穿著、使用、舒適或便利而攜帶的必要或適量的物品和其他個人財物。除另有規定外,包括旅客的托運行李和非托運行李。

1.16 “托運行李”指已經填開行李票并由旅客交承運人負責照管的行李。

1.17 “隨身攜帶物品”指在承運人限定的行李品種、數量、重量和體積范圍內并經承運人同意由旅客自行攜帶乘機并負責照管的行李物品。

1.18 “行李票”指客票中與運輸旅客托運行李有關的部分。

1.19 “行李牌識別聯”指由承運人專為識別托運行李發給旅客的憑據。

1.20 “約定經停地點”指除出發地點和目的地點以外,在客票或在承運人的班期時刻表內列明作為旅客旅行路線上預定經停的地點。

1.21 “中途分程”指經承運人事先同意,旅客在出發地點和目的地點間旅行時由旅客有意安排在某個地點的旅程間斷。

1.22 “損害”是指:

a) 因發生在航空器上或者在上、下航空器的任何操作過程中的事故,造成旅客死亡或者身體傷害而產生的損失;

b) 因發生在航空器上或者托運行李處于承運人掌管之下的任何期間內發生的事件,造成托運行李的毀滅、遺失或者損壞,以及延誤而產生的損失;

c) 因承運人、承運人的受雇人、承運人的代理人的過錯造成的旅客自行照管的非托運行李的損失。

1.23 “代碼共享航班”:指一家或多家航空公司通過協議將指定的航班號置掛于另一家實際運營的航空公司的航班上。

1.24“離站時間”指客票上所列明的起飛時間。

1.25“航班延誤”指航班實際到港擋輪擋時間晚于計劃到港時間超過15分鐘的情況。

1.26 “航班出港延誤”是指航班實際出港撤輪擋時間晚于計劃出港時間超過15分鐘的情況。

1.27“機上延誤”是指航班飛機關艙門后至起飛前或者降落后至開艙門前,旅客在航空器內等待超過機場規定的地面滑行時間的情況。

1.28“超售”是指航班在辦理乘機手續前,其實際定座人數大于該航班執行機型可利用座位數。

2 使用范圍

2.1 一般規定

2.1.1 除2.2條、2.3條、2.4條、2.5條規定外,本條件適用于河北航為取酬而提供的旅客和行李國際航空運輸以及河北航作為實際承運人的代碼共享航段和航班。

2.1.2 除免費和減價的運輸條件、合同、票證另有規定外,本條件同樣適用于免費和減價的運輸。

2.2 在由連續承運人共同承擔的國際航空運輸中,河北航承擔運輸的航段,適用本條件。

2.3 根據河北航包機合同提供的運輸,本條件僅適用于該包機合同和包機客票的條款中所包括的范圍。

2.4 除另有約定外,本條件亦適用于電子客票。

2.5 如本條件中含有與適用的公約、有關國家的法律、政府規定、命令或要求相抵觸的條款,除相抵觸的條款外,本條件的其余條款仍然有效。

2.6 除另有約定外,在河北航規定中如含有與本條件不一致的條款,以本條件為準。

2.7 中國大陸與香港、澳門特別行政區和臺灣地區之間航線的運輸依照本條件執行。

3 客票的一般規定

3.1 客票是客票上所列承運人和旅客之間運輸合同的初步證據。河北航只向持有由河北航或其授權代理人填開的客票的旅客提供運輸。河北航客票始終是河北航的財產。客票中的合同條件是本運輸條件部分條款的概述。客票至少應當包括下列內容:

a) 旅客姓名;

b) 出票人名稱、出票時間和地點;

c) 出發地點和目的地點;

d) 出發地點和目的地點均在中華人民共和國境內,而在境外有一個或者數個約定經停地點的,至少注明一個約定經停地點;

e) 旅客航程的最終目的地點、出發地點或者約定的經停地點之一不在中華人民共和國境內,依照所適用的國際航空運輸公約的規定,應當在客票上聲明此項運輸適用該公約的,客票上應當載有該項聲明。

3.2 旅客未能出示根據河北航規定填開的并包括所乘航班乘機聯和所有其它未使用的乘機聯和旅客聯的有效客票,無權要求乘機。旅客出示殘缺客票或出示非河北航或其授權代理人更改的客票,也無權要求乘機。

3.3 客票不得轉讓。如客票不是由有權乘機或退票的人出示,而河北航非故意性地向出示該客票的人提供運輸或退票,河北航對原客票有權乘機或退票的人,不承擔責任。

3.4 客票不得涂改,涂改的客票無效。

3.5 客票上承運人的名稱可用縮語代碼NS。承運人的地址為客票中的一個“承運人”欄內縮略語代碼對應的出發地機場。

4 客票的有效期

4.1 正常票價的客票有效期自旅行開始之日起一年內運輸有效。如果客票全部未使用,則從填開客票之日起一年內運輸有效。

4.2 折扣票價的客票有效期,按河北航規定的該折扣票價的有效期計算。

4.3 客票有效期的計算,從旅行開始或填開客票之日的次日零時起至有效期滿之日的次日零時為止。

5 客票有效期的延長

5.1 由于河北航的下列原因之一,造成旅客未能在客票有效期內旅行時,其客票的有效期可延長至河北航能夠提供與該客票已付票價相符艙位等級座位的第一個航班為止:

a) 取消旅客已定妥座位的航班;

b) 未在航班約定經停地點降停,而該經停地點是旅客的出發地點、目的地點或中途分程地點;

c) 未能合理地按照班期時刻進行航班飛行;

d) 造成旅客錯失銜接航班;

e) 未能提供旅客原訂艙位等級服務;

f) 未能提供事先已確認的座位。

5.2 由于河北航未能在旅客要求定座時向其提供該航班座位,使持有客票的旅客未能在客票有效期內旅行,該旅客的客票有效期可以延長至河北航能夠按照該客票已付票價的艙位等級提供座位的第一個航班為止。

5.3 已開始旅行的旅客在其持有的客票有效期內因病使旅行受阻時,除河北航對所付票價另有規定外,可將該客票有效期延長至醫療診斷證明該旅客適宜旅行之日為止;或延長至適宜旅行之日以后河北航能夠按照與該旅客已付票價相符艙位等級提供座位的自恢復旅行地點起的第一個航班為止。如客票中未使用的乘機聯包含一個或一個以上中途分程地點,該客票有效期的延長不能超過自該醫療診斷證明列明之日起3個月。河北航也可同等延長患病旅客陪同人員的客票有效期。

5.4 旅客的旅途中死亡,其陪同人員的客票可用取消最短經停期限或延長客票有效期的方法予以更改。如已開始旅行旅客的直系親屬死亡,該旅客及其陪同的直系親屬的客票也可予以更改。此類更改應在收到死亡證明后辦理,該客票有效期的延長不得超過死亡之日起45日。

6 中途分程

旅客可根據政府規定和河北航有關票價條件的要求,在約定的經停地點中途分程。

7 票價和稅費

7.1 票價只適用于從出發地機場至目的地機場的航空運輸,不包括機場與機場或機場與市區之間的地面運輸。

7.2 適用票價是河北航或代表河北航公布的票價,無公布票價時可按河北航的規定組合票價。適用票價是客票第一張乘機聯上的航班運輸開始之日有效的票價,當已收票款與適用票價不符時,應由旅客支付差額或由河北航退還差額。

7.3 票價僅適用于與該票價相關所公布的路線。如果該票價適用于一條以上的路線,旅客可在出票前指定路線,否則由河北航或其授權代理人確定。

7.4 政府、其他當局或機場經營人規定的、對旅客或由旅客使用的任何服務或設施而征收的稅款或費用不包括在公布票價之內,該項稅款或費用應由旅客支付。

7.5 旅客應使用河北航可以接受的貨幣支付票款和費用。如果旅客使用公布票價以外的其他貨幣支付,應按公布的兌換率換算后支付。

8 定座

8.1定座要求

8.1.1 未經河北航或其授權代理人記錄認可,不得認為定座已確認。定座只有在旅客按照河北航規定的手續和購票時限交付票款,經河北航或其授權代理人填開客票,并將該定座列入客票有關乘機聯內交給旅客以后,才能認為座位已經定妥和有效。

8.1.2 河北航可以對某些折扣票價制定條件,以限制或排除旅客變更或取消定座的權利。

8.2 旅客未在河北航規定的實現內交付票款,河北航有權取消旅客所定座位。

8.3 旅客認可其向河北航提供的個人資料,旨在用于定座及安排相關運輸服務。為此,旅客授權河北航保留其個人資料且可將資料傳送給河北航有關部門、其他相關承運人或運輸服務的提供者。同時,河北航及其銷售代理人在售票時將旅客聯系方式等必要信息準確錄入旅客定座編碼中,以便航班不正常時及時通告旅客航班動態信息。

8.4 河北航按旅客已經定妥的航班和艙位等級提供座位,但不保證在飛機上提供旅客所要求的指定座位,旅客同意接受航班上符合客票所列明艙位等級的任何座位。

8.5 旅客未按河北航規定使用已經定妥的座位,也未通知河北航,河北航可以取消其所有已經定妥的續程和回程座位。并可對未使用已定妥座位的旅客收取服務費。

8.6 如旅客購買的是代碼共享航班,在定座、購票時,航空公司及其銷售代理人均應告知旅客該航班的性質、市場方承運人和實際承運人。

9 乘機

9.1 旅客應在航班離站前充足的時間內到達河北航的乘機登記處和登機門,以便辦妥所有政府規定的手續和乘機手續。

9.2 旅客未能按時到達河北航的乘機登記處或登記門,或未出示適當的憑證,或未做好旅行準備,河北航可取消該旅客已定妥的座位,而不延誤航班。由此所造成的損失或費用,河北航不對該旅客承擔責任。

10 拒絕運輸的情形

河北航出于安全原因,或根據其規定,認為屬于下列情形之一時,有權拒絕運輸任何旅客及其行李,由此給旅客造成的損害,河北航不承擔責任:

a) 為遵守出發地點、經停地點、目的地點或飛越國家的法律、規定或命令;

b) 旅客的行為、年齡、精神或健康狀況不適合航空旅行,或可能對其他旅客造成不舒適,或對其本人或其他人員的生命或財產造成危險或危害;

c) 旅客拒絕接受安全檢查;

d) 旅客未支付適用的票價、費用或稅款;

e) 旅客未出示適當的憑證,旅客可能在過境國尋求入境,旅客可能在飛行中銷毀其證件的或旅客不按河北航要求將旅行證件交由機組保存;

f) 旅客出示的客票為非法獲得,或不是在出票承運人或其授權代理人處購買的,或已報告丟失或被盜,或是偽造的,或乘機聯不是由河北航或其授權代理人更改的,或乘機聯被涂改的;

g) 出示客票的人不能證明本人即是票上“旅客姓名”欄內指定的人。

h) 旅客未遵守河北航的其他有關規定。

11 對被拒絕運輸旅客的安排

a) 對根據本條件第1條a)款被拒絕運輸的旅客,河北航按本條件56F02-7節1.4條中非自愿退票的規定辦理;

b) 對根據本條件第1條b)、c)、d)、f)款被拒絕運輸的旅客,河北航按本條件56F02-7節1.5條自愿退票的規定辦理;

c) 對根據本條件第1條e)款被拒絕運輸的旅客,河北航在其補足適用的票價和費用后方可安排運輸。也可按本條件56F02-7節1.4條非自愿退票的規定辦理;

d) 對根據本條件第1條g)、h)款被拒絕運輸的旅客,河北航保留扣留其客票的權利。

12 其他規定

無成人陪伴兒童、無自理能力人、孕婦或患病者等特殊旅客,只有在符合河北航規定的條件下,經河北航及有關承運人同意并做出事先安排后方予載運。

出于安全考慮,河北航對每一航班限制運輸旅客的數量進行控制。超過控制數量的限制運輸旅客,河北航將不予承運。

13 不得作為行李運輸的物品

13.1 旅客不得在其行李中夾帶:

a) 不符合本條件行李定義范圍的物品;

b) 根據國際民用航空組織的《危險品航空安全運輸技術指南》和國際航空運輸協會的《危險品規則》以及河北航規定,屬于危及航空器或航空器上人員財產安全的禁止航空運輸的危險物品;

c) 運輸過程中有關國家的適用法律或命令所禁止運輸的物品;

d) 河北航認為重量、大小、性質不適合運輸的物品,如易碎或易腐物品;

e) 除導盲犬、助聽犬、搜救犬等特殊犬種外,河北航不接受寵物活體動物作為行李運輸。

13.2 非用于狩獵和體育運動的槍支和彈藥禁止作為行李運輸。用于狩獵和體育運動的槍支和彈藥,可憑有效的槍支運輸許可證作為托運行李運輸。槍支必須卸下子彈、扣上保險并妥善包裝。彈藥的運輸應按1條1.1款b)點所述的國際民用航空組織和國際航空運輸協會的有關危險品的規定辦理;

13.3 旅客不得在托運行李中夾帶易碎或者易腐物品、貨幣、珠寶、貴重金屬、金銀制品、流通票證、有價證券和其他貴重物品、商業文件、護照和其他證明文件或者樣品;

13.4 屬于古董或者旅游紀念品的槍、劍、刀及類似物品只能作為托運行李運輸并符合河北航的有關規定。此類物品不得帶入客艙;

13.5 不論是否屬于1條1.1款或1條1.2款所規定的禁止作為行李運輸的物品,如果該物品已被河北航承運,應對其收取費用,其運輸應符合河北航有關責任限制的規定和本條件關于行李運輸的其他規定;

13.6 導盲犬、助聽犬、搜救犬等特殊犬種及其容器均免費運輸,不計入免費行李額,并應遵守河北航的有關規定。

14 拒絕運輸權利

14.1 對本章1條規定不得作為行李運輸的物品,河北航有權拒絕承運或續運。

14.2 河北航可拒絕將包裝、重量、體積或性質不適宜運輸的物品作為行李運輸。

14.3 除非事先已與河北航做出安排,否則河北航可將超過適用免費行李額部分的行李安排在后續航班上運輸。

14.4 托運行李要用行李箱或其他合適的容器妥善包裝,以保證在正常的操作條件下安全運輸,否則河北航可拒絕收運。

15 檢查權利

由于安全和保安原因,河北航或其他安檢單位有權要求旅客允許對其人身或其行李進行檢查。為了確定旅客是否攜有,或其行李內是否夾帶1條1.1款中所規定的物品或者根據1條1.2款所規定是必須向河北航交驗的武器、彈藥,即便旅客不在場,河北航或其他安檢單位有權對其行李進行檢查。對拒絕接受檢查的,河北航有權拒絕運輸該旅客或其行李。

16 托運行李

16.1 所有行李在托運前應當標明旅客的姓名及目的站地址。

16.2 行李一經向河北航托運,河北航必須負責照管,并對每件托運行李拴掛行李牌,并將行李牌識別聯交給旅客。

16.3 河北航應將托運行李的件數、重量填入“客票及行李票”相應欄內。

16.4 托運行李應與旅客同機運輸。如果無法同機運送,河北航可將托運行李安排在載量許可的后續航班上運出。

16.5 河北航國際和地區航線中,不涉及美國航線的,單件托運行李最大重量不得超過32千克。涉及美國航線的,單件托運行李最大重量不得超過45千克。所有單件托運行李最大尺寸(長、寬、高之和)均不得超過300厘米。其中,超過32千克、不超過45千克的單件托運行李,以及三邊之和大于203厘米且小于300厘米的超大行李均需提前咨詢河北航出票單位,填寫申請單,征得河北航同意后方可托運。

17 免費行李額

17.1 河北航在國際和地區航線上實行計件制免費行李額。

17.2 河北航中國-歐洲、韓國、東南亞及內地到港澳臺之間航線免費計件行李額

每一旅客的免費行李額,除河北航另有規定者外,按下列規定辦理:

a) 成人旅客的免費行李額

按適用的商務艙票價購票的旅客,可免費托運2件行李,每件行李最大重量不得超過32千克;按適用的經濟艙票價購票的旅客可免費托運1件行李,每件行李最大重量不得超過23千克,以上規定的免費行李額中,任何一件行李的最大尺寸都不得超過158厘米(長、寬、高三邊之和);

b) 兒童、嬰兒的免費行李額

兒童與按兒童相同票價購票的嬰兒享有與成人旅客相同的免費行李額。按適用票價10%購票的嬰兒可免費托運一件行李,每件行李最大重量不得超過10千克,且其長、寬、高三邊之和不得超過115厘米,另可攜帶一件折疊式嬰兒車。

17.3 河北航中國-澳洲、加拿大、美國、日本之間航線免費計件行李額

每一旅客的免費行李額,除河北航另有規定外,按下列規定辦理:

a) 成人旅客的免費行李額

按適用的頭等艙票價購票的旅客,可免費托運3件行李,每件行李最大重量不得超過32千克;按適用的商務艙票價購票的旅客,可免費托運2件行李,每件行李最大重量不得超過32千克;按適用的經濟艙票價購票的旅客可免費托運2件行李,每件行李最大重量不得超過23千克,以上規定的免費行李額中,任何一件行李的最大尺寸都不得超過158厘米(長、寬、高三邊之和);

b) 兒童、嬰兒的免費行李額

兒童與按兒童相同票價購票的嬰兒享有與成人旅客相同的免費行李額。按適用票價10%購票的嬰兒可免費托運一件行李,每件行李最大重量不得超過10千克,且其長、寬、高三邊之和不得超過115厘米,另可攜帶一件折疊式嬰兒車。

17.4 購買混合等級客票的旅客其免費行李額要根據計件制規定,按各航段票價級別的規定的免費行李額分別計算。

17.5 搭乘同一航班前往同一目的地點或者中途分程地點的兩人或兩人以上的同行旅客,如果在同一時間、同一地點辦理行李托運手續,無論計重或計件,其免費行李額可按各自的票價級別規定的標準合并計算。

17.6 旅客自愿改變航程后的免費行李額,應當按改變航程后客票票價級別所適用的免費行李額的規定辦理。旅客非自愿改變航程后的免費行李額,應當按原客票票價級別所適用的免費行李額的規定辦理。

18 逾重行李

18.1 逾重行李是指托運行李和隨身攜帶物品中超過計重或計件免費行李額的部分。

18.2 逾重行李應當按規定繳納逾重行李費,并在河北航填開逾重行李票后運輸。

18.3  河北航國際和地區航線逾重行李運價費率和計算方法,按照以下標準辦理:

18.3.1 上述標準累加收費,不涉及美國航線的,單件托運行李最大重量不得超過32千克。涉及美國航線的,單件托運行李最大重量不得超過45千克。

18.3.2 超過32千克、不超過45千克的單件托運行李,以及三邊之和大于203厘米且小于300厘米的超大行李均需提前咨詢河北航空出票單位,填寫申請單,征得河北航空同意后方可托運。

18.3.3 聯程運輸航班的逾重行李費標準遵照免費行李額的規則。

19 聲明價值和費用

19.1 旅客的托運行李其價值如果每千克超過20美元或其等值貨幣,可以辦理行李的聲明價值。

19.2 河北航按旅客的行李聲明價值重超過7.1條規定限額部分的價值的5‰收取聲明價值附加費。

19.3 每位旅客托運行李聲明價值的最高限額為2500美元或其等值貨幣。

19.4 托運行李的部分運輸由不提供行李聲明價值服務的其他承運人承擔的,河北航有權拒絕提供聲明價值服務。

20 隨身攜帶物品

20.1 隨身攜帶物品應當能置于前排座位下或者能放置于客艙的封閉式行李架內,體積不得超過20X35X55厘米。

20.2 隨身攜帶物品包括免費攜帶物品和客艙行李。

20.3 免費攜帶物品

20.3.1 根據河北航規定,河北航國際和地區航班每位頭等艙旅客可免費攜帶不超過2件、每件不超過5千克的錨點旅途需用物品;每位商務艙和經濟艙旅客可免費攜帶不超過1件且不超過5千克的旅途需用物品,不占座嬰兒無免費攜帶物品的額度。

20.3.2 此類物品不拴掛行李牌。

20.4 客艙行李

20.4.1 不適于放在貨艙內運輸的行李在事先征得河北航同意的情況下方可作為客艙行李。

20.4.2 客艙行李的重量包括在免費行李額內。

20.4.3 客艙行李拴掛行李牌。

20.4.4 客艙行李的運輸可單獨收費。

21 行李的領取和交付

21.1 行李運達目的地點或中途分程地點以后,旅客應立即領取。

21.2 行李托運后,河北航隨即將行李票及行李牌識別聯交給旅客,旅客憑此認領行李。如果旅客不能出示行李牌識別聯,但能出示行李票并且能用其他方式識別行李,則不影響行李的最終交付。

21.3 行李領取人如果不能出示行李票和行李牌識別聯,應當提供河北航認為滿意的證明以確定對其行李的權利。必要時還須填妥河北航規定的申請書,聲明同意賠償由于該行李交付而可能給河北航造成的任何損害,河北航方予交付行李。

22 航班時刻和航班取消及變更

22.1 河北航將采取一切必要的措施,按照公布的在旅行之日有效的航班時刻,合理地運送旅客及其行李,并按客票及行李票上合同條件的有關規定辦理。

22.2 航班取消與變更

由于下列原因之一的,河北航可不經事先通知,改變機型或航線、取消、中斷、推遲或延期航班飛行:

a) 為遵守任何起飛地國家、降落地國家或所飛越國家的任何適用的法律、政府規定和命令;

b) 為保證飛行安全;

c) 河北航無法控制或不能預見的其他原因。

23 自愿變更

23.1 旅客已開始旅行但未到達目的地點前要求改變客票中未使用部分載明的航程、目的地點、承運人、座位等級、航班或者客票有效期,為自愿變更。

23.2 自愿改變航程,按下列規定辦理:

a) 旅客應當在未到達客票載明的目的地點前提出;

b) 改變航程后,應當適用原客票第一張乘機聯載明的運輸開始之日所適用的票價和各項費用;

c) 改變航程后的票價和各項費用與原票價和各項費用的差額,應當由旅客支付或者由承運人退還;

d) 改變航程后填開新客票的有效期應當與原客票所適用的有效期相同,并從原客票第一張乘機聯載明的運輸開始之次日零時起計算。

24 非自愿變更

24.1 由于1.2條所列原因,河北航取消或延誤航班、或未能提供旅客事先定妥的座位、或造成旅客錯失已定妥座位的銜接航班、或未能在旅客的目的地點或中途分程地點經停,河北航必須考慮旅客合理需要,采取下列措施之一:

a) 為旅客安排河北航第一個可利用座位的后續航班;

b) 改變原客票列明的航程,安排河北航的航班或簽轉給其他承運人的航班或通過地面運輸方式將旅客運達目的地點或中途分程地點。對改變航程后的客票票價、逾重行李費和其它費用,河北航應多退少不補;

c) 按本條件52F02-7非自愿退票規定辦理退票;

24.2 協助旅客安排膳宿、地面交通等服務。 由于河北航的原因,取消或延誤航班、或未能提供旅客事先定妥的座位、或造成旅客錯失已定妥座位的銜接航班、或未能在旅客的目的地點或中途分程地點經停,河北航除按本條件3.1條a)、b)、c)款規定辦理外,還應按河北航規定免費為旅客提供休息場所、飲料、食品、膳宿或其他河北航認為必要的服務。

24.3 除非損害是由于河北航故意或明知可能造成損害而輕率地作為或不作為所造成的,河北航對班期時刻表或其他公布的航班時刻中的差錯或遺漏不承擔責任。對其雇員、代理人或河北航的代表就出發或到達時間、日期或任何航班飛行所作的解釋也不承擔責任。

25 退票

25.1 由于河北航未按照運輸合同提供運輸或旅客要求自愿變更其旅行安排,河北航應對旅客未使用的全部或部分客票,按本條件和河北航的有關規定辦理退票。

25.2 旅客要求退票應按河北航規定提交退票申請。

25.3 退票受款人

25.3.1 除本章另有規定外,河北航有權向客票上列明姓名的旅客本人辦理退票,也可憑滿意的證明向該客票的付款人退票。

25.3.2 如果客票上列明的旅客不是客票的付款人,并且客票上列明退票限制條件,河北航應按列明的退票限制條件將票款退給付款人或其指定人。

25.3.3 河北航將票款退給持有客票并符合本條件1.3.1條和1.3.2條規定的人,被認為是正當退票,河北航也隨即解除責任。

25.4 由于河北航或河北航無法控制的原因,旅客非自愿改變航程造成未能按運輸合同完成運輸的退票,稱為非自愿退票。非自愿退票按下列規定辦理:

25.4.1 客票全部未使用,退還全部已付票款。

25.4.2 客票已部分使用,從已付票款中扣除已使用部分的票款,其余額與從旅行中斷地點至目的地點或下一個中途分程地點扣除了使用的折扣和費用的單程票價相比較,取其高者退還旅客,但所退票款不得超過原票款的總額。

25.5 凡不屬于本條件1.4條非自愿退票范圍內的退票稱為自愿退票。自愿退票按下列規定辦理:

25.5.1 客票全部未使用,從已付票款中扣除河北航規定的適用費用,退還余額;

25.5.2 客票已部分使用,從已付票款中扣除已使用部分的適用票價和河北航規定的適用費用,退還余額。

25.6 旅客遺失客票要求退票,河北航可根據其規定辦理。

25.6.1 旅客遺失客票要求退票,必須在該客票有效期滿后的30日內辦理。退票時,旅客須提供河北航認為滿意的證明,填妥河北航規定的退票申請書,聲明同意賠償由此造成河北航的一切損害,包括已經或今后被他人冒用或冒退以及必要的訴訟費用等任何損害,經河北航同意后方可辦理。

25.6.2 旅客遺失客票的退票,按1.5條自愿退票的規定辦理。

25.7 拒絕退票

25.7.1 旅客在客票超出客票有效期30日后提出退票申請,河北航可以拒絕辦理。

25.7.2 對已提供給承運人或政府機構作為準備離境證明的客票,河北航可以拒絕退票。如果該旅客已經得到該政府機構批準同意其居留或將改乘其他承運人航班或其他交通工具離境,并能提供河北航認為滿意的證明時,河北航方可辦理退票。

25.8 旅客要求退票,必須符合原購票地點國家和退票地點國家的法律、政府規定和命令。河北航應按原收取票款的貨幣退票,但也可按河北航規定的其他貨幣退票。

25.9 旅客要求退票應由河北航或其授權代理人辦理。退票地點必須為原購票地點或經河北航同意的其他地點。

26 國際旅客服務

26.1 除另有規定外,機上供應的餐食由河北航提供。但河北航不能保證超過規定的品種和數量的餐食服務。

26.2 河北航為旅客提供與航空運輸有關的其他服務安排,除由于河北航故意或疏忽造成的損害外,河北航對此不承擔責任。

27 不正常航班的服務

27.1 由于河北航的原因,造成航班備降、取消或延誤,應按河北航規定免費為旅客提供休息場所、飲料、食品、膳宿或其他河北航認為必要的服務,對老弱病殘、孕婦、抱小孩旅客、無人陪兒童等需要特殊照顧的旅客優先保障。

27.2 由于天氣、突發事件、空中交通管制、安檢以及旅客等非河北航原因,造成航班在始發地出港延誤或取消,河北航應協助旅客安排餐食和住宿,費用應由旅客自理。

27.3 河北航將采取一切必要的措施來避免旅客以及旅客的行李延誤。如河北航已經采取了一切必要的措施或不可能采取該措施的,河北航不承擔責任。

27.4 河北航航班出港延誤或取消,河北航及其授權地面服務代理人應及時將航班出港延誤或取消的信息通知旅客,每半小時發布一次航延動態信息,并做好解釋工作。

27.5 旅客有需要時,河北航可向旅客開具不正常航班證明。旅客有需要時,可通過河北航直銷機構或河北航官網開具航班不正常證明。

27.6 由于河北航機務維護、航班調配、機組等河北航自身原因造成航班延誤預計4小時(含)以上時,給予旅客經濟補償,補償標準按照本節第3條執行。

27.7 機上延誤超過2小時(含)的,河北航為機上旅客提供飲用水和食品。

27.8 機上延誤超過3個小時(含)且無明確起飛時間的,河北航將在不違反航空安全、安全保衛規定的情況下,安排旅客下飛機等待。

27.9 本條所列的補救措施是旅客可選擇的全部補救措施。除公約、法律另有規定外,河北航不再承擔其他責任。

27.10 如果航班始發點、目的地點或經停點所在國家或地區的法律、政府規定、命令與本條件規定不一致的,按當地規定執行。

28 河北航自身原因造成航班延誤給予旅客經濟補償標準

28.1 河北航對因河北航原因造成的航班延誤達4小時或以上的航班旅客(含嬰兒和兒童旅客)進行經濟補償,嬰兒和兒童旅客與成人旅客的補償標準一致。

28.2 補償標準:根據給予經濟補償的航班延誤時間長短計算。具體標準如下表:

28.3 補償方式:采用現金、積分或與旅客協商一致的其他替代補償方式予以補償。

28.4 如果航班始發點、目的地點或經停點所在國家或地區的法律、政府規定、命令所要求的賠償標準與本條件規定不一致的,按當地規定標準執行。

29 航空器上的行為

29.1 如果旅客在航空器上的行為危及到航空器或航空器上任何人或財產的安全、或妨礙機組人員履行職責、或不遵守機組的指示、或其他旅客有理由反對的行為,河北航可以采取其認為必要的措施,以阻止該行為的繼續,包括對該旅客實施必要的管束。

29.2 旅客不得在航空器上使用收音機、錄音機、移動電話、電子游戲機或包括無線電操控的玩具和對講機在內的發射裝置。未經河北航允許,旅客不得在航空器上使用除助聽器和心臟起搏器以外的任何電子設備。

30 行政手續

30.1 旅客應對遵守起飛地國家、降落地國家、或飛越國家的所有法律、規定、命令、要求和旅行條件,以及河北航的規定和指示負全部責任。河北航對其代理人或雇員向旅客提供的與獲取必要的證件或簽證或遵守上述法律、規定、命令、要求和條件有關的無論是書面的或是其他方式的幫助或信息不承擔責任。對旅客因未能獲取上述證件或簽證或遵守上述法律、規定、命令、要求、條件、規定或指示而導致的后果不承擔責任。

30.2 旅客應出具有關國家的法律、規定、命令、要求或條件所要求的所有出入境、健康和其他證件。河北航對未遵守法律、規定、命令、要求或條件或證件不符合要求的旅客,保留拒絕載運的權利。

30.3 由于過境國或目的地國家不允許旅客過境或入境,河北航應按政府的命令將旅客運回其出發地點或其他地點時,旅客必須支付適用的票價。河北航可用旅客已支付的用于尚未使用航段的任何票款或由河北航掌管的該旅客的任何資金低付該票價。用于運送至拒絕入境地點或遣返地點的客票,河北航不予辦理退票。

30.4 如旅客未遵守有關國家的法律、規定、命令、要求和旅行條件或未出具所要求的文件,導致河北航支付罰金或負擔任何費用,旅客應按河北航的要求償還河北航已付的全部罰金、抵押金和因此而產生的任何費用。對上述費用的收取,河北航可以使用旅客已支付的未使用航段票款或由河北航掌管的該旅客的任何資金。

30.5 海關和其他政府官員檢查旅客的行李時,旅客應當到場。旅客未遵守該要求而遭受的任何損失,河北航不承擔責任。

30.6 旅客必須遵守運輸過程中有關國家的法律、政府規定、命令、要求和旅行條件的各項規定,服從政府或機場管理和河北航的安全檢查。

31 損害賠償責任

31.1 根據一本客票或一本客票和與其有關而填開的連續客票由幾個連續承運人共同承擔的運輸,應視為是一個單一運輸。

31.2 由河北航作為承運人的國際運輸,且是公約適用的國際運輸,應當適用公約中關于責任的規定和限額。關于公約賠償責任限額的適用如下:

a) 若屬于1999年《蒙特利爾公約》規定的“國際運輸”,則優先適用該公約關于責任限額的規定;

b) 若屬于1929年《華沙公約》或1955年《海牙議定書》規定的“國際運輸”,但不屬于1999年《蒙特利爾公約》規定的“國際運輸”,則適用《華沙公約》或《海牙議定書》關于責任限額的規定。

31.3 公約關于賠償責任限額的規定

31.3.1 《華沙公約》或《海牙議定書》

a) 適用《華沙公約》的國際運輸,河北航對旅客傷亡的賠償責任限額不超過125,000法國金法郎或等值貨幣。適用《海牙議定書》的國際運輸,河北航對旅客傷亡的賠償責任限額不超過250,000法國金法郎或等值貨幣;

b) 河北航對托運行李的賠償責任限額不超過每公斤250法國金法郎或等值貨幣;對隨身攜帶物品和旅客隨身攜帶物品的責任限額不超過每一旅客5,000法國金法郎或等值貨幣。行李票上如果沒有行李重量記錄,托運行李的總重量被認為不超過所乘座位等級適用的免費行李額。按照56F02-5第7條辦理聲明價值的托運行李,其損害賠償以該聲明價值為限。

31.3.2  1999年《蒙特利爾公約》

a) 河北航對每名旅客不超過113,100特別提款權的旅客傷亡賠償責任適用公約第二十條和第二十一條第一款的規定;

b) 河北航對在航空運輸中因延誤引起的損失,賠償責任限額不超過每位旅客4,694特別提款權或等值貨幣。但是,經證明河北航及其受雇人和代理人為了避免損失的發生,已經采取一切可合理要求的措施或者不可能采取此種措施的,河北航不對因延誤的損失承擔責任;

c) 河北航對行李(包括托運行李和隨身攜帶物品)的賠償責任限額不超過每名旅客1,131特別提款權或等值貨幣。按照56F02-5第7條辦理聲明價值的托運行李,其損害賠償以該聲明價值為限。

31.4 對不適用于公約的國際運輸:

a) 河北航僅對由于河北航故意促成的或明知可能造成損害而輕率地作為或不作為造成的旅客或其托運行李的損害承擔責任。如果損害是由于旅客過失造成或促成的,應按照適用的法律法規相應免除或減輕河北航的賠償責任;

b) 由于河北航故意促成的損害或明知可能造成損害而輕率地作為或不作為的損害,河北航對每位旅客死亡、受傷或其他人身傷害承擔的責任限額為113,100特別提款權或等值貨幣;

c) 由于河北航故意或明知可能造成損害而輕率地作為或不作為的損害,河北航空對行李(包括托運行李和隨身攜帶物品)害的責任限額為1,131特別提款權或等值貨幣。按照56F02-5第7條辦理聲明價值的托運行李,其損害賠償以該聲明價值為限。

31.5在與上述條款不相沖突的情況下,無論公約是否適用:

31.5.1 河北航僅對發生在其自身航班上的損害承擔責任。河北航為其他承運人的運輸(含代碼共享航班)出具客票或辦理行李托運時,僅作為該承運人的代理人,盡管如此,旅客享有對其托運行李向第一或最后承運人訴訟的權利。對于非河北航實際承運的航班(含代碼共享航班),如發生航班變更,延誤,取消,超售,行李破損或丟失,人身損害情況,由實際承運人承擔相應的賠償責任,河北航可協助聯系實際承運人。

31.5.2 河北航為遵守任何法律、政府規定、命令和要求或旅客未遵守而引起的任何損害,河北航不承擔責任

31.5.3 如果行李票上沒有記錄行李的重量,托運行李的總重量應被認為沒有超過相應艙位等級所適用的免費行李額。如旅客對托運行李聲明了較高價值,河北航的責任應限于該聲明價值。

31.5.4 河北航的責任,應不超過經證明損害的賠償數額。河北航對間接的或隨之引發的損害不承擔責任。

31.5.5 由于旅客行李內裝物品造成該旅客傷害或其行李損害,河北航不承擔責任。由于旅客行李內裝物品對他人造成傷害或對他人物品或對河北航的財產造成損害,該旅客應當賠償河北航的所有損害和由此支付的一切費用。

31.5.6 對于旅客托運行李內裝的易碎或易腐物品、貨幣、珠寶、貴重金屬、金銀制品、流通票證、有價證券和其他貴重物品,商務文件、護照和其他證明文件或樣品的損害,河北航只承擔一般托運行李的賠償限額。

31.5.7 旅客在運輸時由于其年齡、精神或健康狀況,對本人形成危害和危險,河北航不承擔由此造成或加重其本人的任何疾病、受傷、死亡、殘疾的責任。

31.5.8 對河北航責任的任何免除和限制適用于并有利于河北航的代理人、雇員和代表以及將飛機提供給河北航使用的任何人及其代理人、雇員和代表。上述代理人、雇員、代表以及其他任何人可從河北航收回的賠償總額,不得超過河北航的責任限額。

31.5.9 以上明確規定的各項,不排除公約或適用法律規定的承運人責任的任何免除和限制。

32 索賠和訴訟時限

32.1 在交付托運行李時,行李票的持有人收受托運行李而未提出異議,為該托運行李已經在良好狀況下并在與運輸合同相符的情況下交付的初步證據,除非旅客出具相反的證據。

32.2 托運行李發生損害的,有權提取托運行李的人必須在發現損害時提出異議,并至遲自收到托運行李之日起七日內,以書面形式向河北航提出索賠。托運行李發生延誤的,必須至遲自托運行李交付收件人處置之日起二十一日內以書面形式向河北航提出索賠。

32.3 河北航承認托運行李已經遺失,或者托運行李在應當到達之日起二十一日后仍未到達的,旅客有權向河北航行使運輸合同所賦予的權利。

32.4 關于賠償責任的訴訟時效,應當從航空器到達目的地點之日、應當到達目的點之日或者運輸終止之日起兩年內提出,否則旅客喪失任何損害的賠償的權利。

 

 

1 Definitions

In Hebei Airlines Conditions of Carriage for International Passengers and Baggage (hereinafter referred to as Conditions), except where the context otherwise requires or where it is otherwise expressly provided, the following expressions have the meanings respectively assigned to them, that is to say:

1.1 “CONVENTION” means the following documents applied to the carrige according to the agreement provisions.

a) The Convention for the unification of certain rules of international carriage by air which was agreed on 12 October 1929 in Warsaw (the Warsaw Convention) .

b) The Convention for the unification of certain rules of international carriage by air which was agreed on 18 September 1955 in Hague( the Hague Agreement).

c) the Convention for unification of certain rules for international carriage by air which was agreed 28 May 1999 in Montreal (the Montreal Convention).

1.2 “INTERNAITONAL CARRIAGE” means carriage in which, according to a contract of carriage, one or more places of departure, destination and agreed stopping place is/are situated outside the People’s Republic of China.

1.3 “CARRIER” includes the air carrier issuing the ticket and all air carriers that carry or undertake to carry the passenger and/or his baggage there under.

1.4 “NS” is the abbreviation of Hebei Airlines. 1.2(English name: HEBEI AIRLINES, IATA membership code: NS, ICAO specified code: HBH, IATA Settlement Code: 836, Address: No.303, Zhongshan Eastern Road, Shijiazhuang City, Website: www.01772767.com).“NS” is the abbreviation of Hebei Airlines.

1.5 “HEBEI AIRLINES REGULATIONS” means rules, other than these Conditions, published by the carrier and in effect on date of ticket issue, governing carriage of passengers and/or baggage and shall include applicable tariffs in force.

1.6 “HEBEI AIRLINES AUTHTORIZED AGENTS” means an agent authorized by Hebei Airlines providing sales support for Hebei Airlines flights.

1.7 “PASSENGER” means any person, except members of the crew, carried or to be carried in an aircraft with the consent of the carrier.

1.8 “TICKET” means the document entitled “Passenger Ticket and Baggage Check” issued by or on behalf of the carrier and includes the Conditions of Contract and Notices and the flight and passenger coupons contained therein.

1.9 “CONJUNCTION TIKCKET”means a ticket issued to a passenger in conjunction with another ticket which together constitutes a single contract of carriage.

1.10 “FLIGHT COUPON” means that portion of the ticket that bears the notation “good for passage” and indicates particular places between which passengers are entitled to be carried.

1.11 “PASSENGER COUPON” or “PASSENGER RECEIPT” meansthat portion of the ticket marked with “Passenger Coupon” which ultimately is to be retained by the passenger.

1.12 “DAYS” means calendar days,including all seven days of the week; provided that, for the purpose of notification, the day upon which a notice is dispatched shall not be counted; and that for purposes of determining duration of validity, the day upon which the ticket is issued, or the flight commenced, shall not be counted.

1.13 “NORMAL FARE”means the highest fare approved for carriage in a given class of carriage during the applicable period of fares.

1.14 “SPECIAL FARE” means a fare other than the normal fare.

1.15 “BAGGAGE” means such articles, effects and other personal property of a passenger as are necessary or appropriate for wear, use, comfort or convenience in connection with the trip. Unless otherwise specified, it includes both checked and unchecked baggage of the passenger.

1.16 “CHECKED BAGGAGE” means baggage of which the carrier takes custody and for which the carrier has issued a baggage check.

1.17 “CARRIED-ON ITEMS” means the baggage items which are within the carrier’s limited baggage types, numbers, weight and size allowances , agreed by the carrier and carried  on board and taken care of by the passengers themselves on board.

1.18 “BAGGAGE CHECK” means those portions of the ticket which relate to the carriage of the passenger's checked baggage.

1.19 “BAGGAGE IDENTIFICATION TAG” means a document issued by the carrier solely for identification of checked baggage.

1.20 “AGREED STOPPING PLACES” means those places, except the place of departure and the place of destination, set forth in the ticket or shown in the carrier's timetables as scheduled stopping places on the passenger's route.

1.21 “STOPOVER” means a deliberate interruption of a journey by the passenger, at a point between the place of departure and the place of destination, which has been agreed to in advance by the carrier.

1.22 “DAMAGE” includes:

a) In the case of passenger bodily injury or death, damage sustained and caused by an accident occurring on board the aircraft or in the course of any of the operations of embarking or disembarking;

b) In the case of loss, damage to or destruction of checked baggage, damage sustained while the checked baggage is on board the aircraft or at any time that the checked baggage is in charge of the carrier;

c) In the case of unchecked baggage of which the Passenger takes charge, damage caused by the fault of the carrier or the employees/agents of the carrier.

1.23 “CODE-SHARE FLIGHT” means a carrier or several carriers use their airline designator code respectively on a flight operated by another carrier in accordance with agreements.

2 Applicability

2.1 General

2.1.1 Except as provided in Para 2.2, 2.3, 2.4 and 2.5, these Conditions apply to all international carriage by air of passengers and baggage, performed by Hebei Airlines for remuneration; regarding code-share segments and flights, these Conditions also apply to carriage in which Hebei Airlines is the operating carrier.

2.1.2 These Conditions also apply to gratuitous and discounted fare carriage except to the extent that Hebei Airlines has provided otherwise in its Regulations or in the relevant contracts, passes or tickets.

2.2 These Conditions apply to the segments operated by Hebei Airlines for the international carriage jointly performed by several successive carriers.

2.3 If carriage is performed pursuant to a charter agreement, these Conditions apply only to the extent they are incorporated by reference in the terms of the charter agreement and the charter ticket.

2.4 To the extent that any provision contained or referred to herein is contrary to anything contained in the Convention where applicable and in any applicable laws, government regulations, orders or requirements, such provision shall not apply. The invalidity of any provision shall not affect the validity of any other provision of these Conditions.

2.5 Except as provided herein, in the event of inconsistency between these Conditions and Hebei Airlines Regulations, these Conditions shall prevail.

2.6 Carriage on routes between the Chinese Mainland and Hong Kong, Macao and Taiwan shall comply with these Conditions.

3 Tickets

3.1 General

3.1.1 The ticket constitutes prima facie evidence of the contract of carriage between the carrier and the passenger named on the ticket.Hebei Airlines will provide carriage only to the passenger holding a ticket issued by Hebei Airlines or its authorized agent.Hebei Airlines ticket remains the property of Hebei Airlines. The Contract Conditions listed on the ticket are a summary of some of the provisions of these Conditions of Carriage. The ticket shall at least include the following contents:

a) The name of the passenger

b) The name of the staff issuing the ticket, issuing ticket time and place;

c) The departure place and destination;

d) The departure place and destination are all in the areas of People’s Republic of China. If there are  one or several appointed stopover places, at least one appointed stopover place shall be noted.

e) If one of the destination, departure place or the appointed place is not in the areas of People’s Republic of China, according to the applicable convention of international carriage by air, which shall be noted on the ticket the convention applies to the carriage, the ticket shall have the note on it. 

3.1.2 A passenger shall not be entitled to be carried on a flight unless that passenger presents a valid ticket issued pursuant to Hebei Airlines Regulations containing the flight coupon for that flight and all other unused flight coupons and the passenger coupon. In addition, a passenger shall not be entitled to be carried if the ticket presented is mutilated or if it has been altered other than by Hebei Airlines or its authorized agent.

3.1.3 Tickets are not transferable. If a ticket is presented by someone other than the person to whom it was issued for transport or for a refund,Hebei Airlines shall not be liable to the original ticket holder if in good faith it provides carriage or makes a refund to the person presenting the ticket.

3.1.4 A ticket is invalid if it has been tempered with.

 

3.2 Period of validity

3.2.1 A ticket issued at normal fare is valid for carriage for one year from the date of commencement of travel or if no portion of the ticket is used, from the date of issue thereof.

3.2.2 A ticket issued at special fare is valid for carriage only for the period subject to the conditions prescribed in Hebei Airlines Regulations.

3.2.3 The validity period of a ticket starts from the commencement of travel or midnight of the second day after the ticket is issued and ends at midnight of the second day after the period expires.

3.3 Extension of validity

3.3.1 If a passenger is prevented from traveling within the period of validity of the ticket because Hebei Airlines:

a) cancels the flight on which the passenger holds a reservation; or

b) omits a scheduled stop, being the passenger's place of departure, place of destination or a stopover; or

c) fails to operate a flight reasonably according to schedule;or

d) causes the passenger to miss a connection; or

e) substitutes a different class of service; or

f) is unable to provide previously confirmed space.

The validity of such passenger's ticket will be extended until Hebei Airlines first flight on which space is available in the class of service for which the fare has been paid.

3.3.2 If a passenger holding a valid ticket is prevented from traveling within the valid period of the ticket because Hebei Airlines fails to provide a seat on the flight in accordance with the passenger’s reservation, the validity of such passenger's ticket will be extended until Hebei Airlines first flight on which space is available in the class of service for which the fare has been paid.

3.3.3 If a passenger after having commenced his or her journey is prevented from traveling within the period of validity of the ticket by reason of illness, unless precluded by Hebei Airlines’ regulations applicable to the fare paid by the passenger, Hebei Airlines will extend the period of validity of such passenger's ticket until the date when the passenger becomes fit to travel according to a medical certificate, or until Hebei Airlines first flight after such date from the point where the journey is resumed on which space is available in the class of service for which the fare has been paid. When the flight coupons remaining in the ticket involve one or more stopovers, the validity of such ticket will be extended for not more than three months from the date shown on such a certificate. In such circumstances, Hebei Airlines will extend similarly the period of validity of tickets ofother members accompanying the incapacitated passenger.

3.3.4 In the event of death of a passenger en-route, the tickets of the persons accompanying the passenger may be modified by waiving the minimum stay or extending the validity. In the event of a death in the immediate family of a passenger who has commenced travel, the validity of the passenger's ticket and those of his or her immediate family accompanying the passenger may be likewise modified. Any such modification shall be made upon receipt of a valid death certificate and any such extension of validity shall not be for a period longer than forty-five(45) days from the date of death.

4 Stopovers

Stopovers may be permitted at agreed stopping places subject to government requirements and Hebei Airlines relevant tariff conditions.

5 Fares and charges

5.1 Fares apply only for carriage from the airport at the place of departure to the airport at the place of destination. Fares do not include ground transport service between airports and between airports and townareas.

5.2 Applicable fares are those published by or on behalf of Hebei Airlines or, if not so published, constructed in accordance with Hebei Airlines Regulations. The applicable fare is the fare for the flight or flights in effect on the date of commencement of the carriage covered by the first flight coupon of the ticket. When the amount that has been collected is not the applicable fare, the difference shall be paid by the passenger, or, as the case may be, refunded by Hebei Airlines.

5.3 Unless otherwise provided in Hebei Airlines Regulations, fares apply only to routings published in connection therewith. If there is more than one routing at the same fare, the passenger may specify the routing prior to issue of the ticket. If no routing is specified, Hebei Airlines or its authorized agent may determine the routing.

5.4 Any tax or charge imposed by government or other authority, or by the operator of an airport, in respect of a passenger or the use by a passenger of any services or facilities will not be included in the published ticket fare and shall be payable by the passenger.

5.5 Fares and charges are payable in any currency acceptable to Hebei Airlines. When payment is made in a currency other than the currency in which the fare is published, such payment will be made at the rate of exchange published by a bank on the day such payment is made.

6 Reservations

6.1 Reservation requirements

6.1.1 Reservations are not confirmed until recorded as accepted by Hebei Airlines or its authorized agent. Reservations will not be valid until the fare has been paid in accordance with the procedures and time limits set forth by Hebei Airlines and a ticket has been issued with the reservations listed on the corresponding flight coupon by Hebei Airlines or its authorized agent.

6.1.2 As provided in Hebei Airlines Regulations, certain fares may have conditions which limit or exclude the passenger's right to change or cancel reservations.

6.2 If a passenger has not paid for the ticket prior to the specified ticketing time limit, Hebei Airlines may cancel the reservation.

6.3 The passenger recognizes that personal data has been given to Hebei Airlines for the purposes of making a reservation for carriage and for obtaining ancillary services. For these purposes, the passenger authorizes Hebei Airlines to retain such data and to transmit it to its own offices, other carriers or the providers of such services. In the meantime, Hebei Airlines and its sales agent enter the necessary information such as the passenger contact phone number exactly into the passenger seat reservation code when selling tickets so as to inform passengers flight dynamics in time when incountered with abnormal flights.

6.4 Hebei Airlines does not guarantee to provide any particular seat in the aircraft and the passenger agrees to accept any seat that may be allotted on the flight in the class of service for which the ticket has been issued.

6.5 If a passenger fails to occupy space that has been reserved for him on a flight and without any notice, Hebei Airlines shall be entitled to cancel any onward or return reservations that Hebei Airlines has made or procured for the passenger.A service charge may be payable by such passenger who fails to use space for which a reservation has been made.

6.6 If a passenger holding an onward or return ticket stays at the onward or returning point for a period longer than 72 hours, he must reconfirm his onward or return reservation at least 72 hours before flight departure, otherwise the reservation may be cancelled. If a passenger arrives at the onward or return point within 72 hours before flight departure, no reconfirmation is needed.

6.7 If a passenger purchases a ticket for a code-share flight, Hebei Airlines and its sales agent shall inform the passenger about the nature, marketing carrier and operating carrier of the flight in reservation and ticket purchase.

7 Check-in

7.1 The passenger shall arrive at Hebei Airlines check-in location and boarding gate sufficiently in advance of flight departure to permit completion of any government formalities and departure procedures.

7.2 If the passenger fails to arrive in time at Hebei Airlines check-in location or boarding gate or appears improperly documented and not ready to travel, Hebei Airlines may cancel the space reserved for the passenger and will not delay the flight. Hebei Airlines is not liable to the passenger for loss or expense due to the passenger's failure to comply with the provisions of this paragraph.

8 Refusal and limitation on carriage

8.1 Hebei Airlines may refuse carriage of any passenger or passenger's baggage, without liability to the passenger for any loss resulting there from, for reasons of safety or if, in the exercise of its reasonable discretion, Hebei Airlines determines that:

a) such action is necessary in order to comply with any applicable laws, regulations or orders of any state to be flown from, to or over; or

b) the conduct, age, mental or physical state of the passenger is unfit for air transportation and is such as to cause discomfort to other passengers or present a hazard or risk to himself or herself or to other persons or to property; or

c) the passenger has refused to submit to a security check; or

d) the passenger has not paid the applicable fareor any charges or taxes payable; or

e) the passenger does not appear to have valid travel documents, or the passenger may seek to enter a country through which he or she may be in transit or the passenger may destroy his or her documents during flight or refuse to surrender his or her travel documents to the flight crew, against receipt, when requested; or

f) the ticket presented by the passenger has been acquired unlawfully or has been purchased from an entity other than Hebei Airlines or its authorized agent or has been reported as being lost or stolen or is a counterfeit ticket, or the flight coupon has been altered by anyone other than Hebei Airlines or its authorized agent or has been mutilated; or

g) the person presenting the ticket cannot prove that he or she is the person named in the “Name of Passenger” box of the ticket.

h) such action is necessary because the passenger has failed to observe the instructions of Hebei Airlines.

8.2 Arrangements for passengers who are refused for carriage:

a) As for the passenger who is refused for carriage due to reasons described in item a) of Para 8.1, Hebei Airlines will make a refund in accordance with regulations specified in Para 11.4 “Involuntary refund”;

b) As for the passenger who is refused for carriage due to reasons described in item b), c), d), f) of Para 8.1, Hebei Airlines will make a refund in accordance withregulations specified in Para 11.5 “Voluntary refund”;

c) As for the passenger who is refused for carriage due to reasons described in item e) of Para 8.1, Hebei Airlines will accept for carriage after the passenger paid up the fare and charge difference, or make a refund in accordance withregulations specified in Para 11.4 “Involuntary refund”;

d) As for the passenger who is refused for carriage due to reasons described in item g), h) of Para 8.1, Hebei Airlines reserves the right to retain his/her ticket.

8.3 Acceptance for carriage of special passengers, such as unaccompanied children, incapacitated persons, pregnant women or persons with illness is subject to prior consent and arrangement with Hebei Airlines in accordance with Hebei Airlines Regulations.

In consideration of safety, Hebei Airlines will control the number of the passengers whose carriage is limited. Hebei Airlines will not carry passengers surpassing the restricted number.

9 Baggage

9.1 Items unacceptable as baggage

9.1.1 The passenger shall not include in his or her baggage:

a)  Items which do not constitute baggage as defined in Para 1 hereof;

b)  Items such as those specified in the International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air, the International Air Transport Association (IATA) Dangerous Goods Regulations and Hebei AirlinesRegulations, which are likely to endanger the aircraft or persons or property on board the aircraft and prohibited from air transport;

c) Items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from, to or over;

d) Items which in the opinion of Hebei Airlines are unsuitable for carriage by reason of their weight, size or character, such as fragile or perishable items;

e) Other than special dog breeds such as seeing eye dog, hearing dog and search and rescue dog, Hebei Airlines does not accept live pet animals to be transported as baggage.

9.1.2 Firearms and ammunition, other than for hunting and sporting purposes, are prohibited from carriage as baggage. Firearms and ammunition for hunting and sporting purposes may be accepted as checked baggage,which are subject to valid Firearms Transport Permit. Firearms must be unloaded with the safety catch onand suitably packed. Carriage of ammunition is subject to ICAO and IATA regulations as specified in sub-item a) 2) above;

9.1.3 The passenger shall not include in his/her checked baggage, fragile or perishable items, money, jewelry, precious metals, silverware, negotiable papers, securities or other valuables, business documents, passports and other identification documents or samples;

9.1.4 Weapons such as antique firearms, swords, knives and similar items may be accepted as checked baggage, in accordance with Hebei Airlines Regulations, but will not be permitted in the cabin;

9.1.5 If any items referred to in item a) or b) of Para 9.1 are carried, whether or not they are prohibited from carriage as baggage, the carriage thereof shall be subject to the charges, limitations of liability and other provisions of these Conditions applicable to the carriage of baggage.

9.1.6 Special dog breeds such as seeing eye dog, hearing dog and search and rescue dog, together with containers, will be carried free of charge in addition to the normal free baggage allowance, and subject to Hebei Airlines Regulations.

9.2 Right to refuse carriage

9.2.1 Hebei Airlines may refuse carriage as baggage of such items described in Para 9.1 above which are prohibited from carriage as baggage and may refuse further carriage of any such items on discovery thereof.

9.2.2 Hebei Airlines may refuse to carry as checked baggage such items as their package, weight, volume or character is not suitable for carriage.

9.2.3 Unless advance arrangements for its carriage have been made with Hebei Airlines, Hebei Airlines may carry on later flights baggage which is in excess of the applicable free allowance.

9.2.4 Hebei Airlines may refuse to accept baggage as checked baggage unless it is properly packed in suitcases or other suitable containers to ensure safe carriage with ordinary care in handling.

9.3 Right to search

For reasons of safety and security, Hebei Airlines or other security authorities may request the passenger to permit a search to be made of his or her person and his or her baggage, and may search or have searched the passenger’s baggage in his or her absence if the passenger is not available, for the purpose of determining whether he or she is in possession of or whether his or her baggage contains any items described in item a) of Para 9.1 or any arms or ammunitions which have not been presented to Hebei Airlines in accordance with item b) of Para 9.1. If the passenger is unwilling to comply with such request,Hebei Airlines may refuse to carry the passenger or baggage.

9.4 Checked baggage

9.4.1 The passenger shall mark his/her name and destination to the baggage prior to acceptance.

9.4.2 Upon delivery to Hebei Airlines of baggage to be checked, Hebei Airlines shall take custody thereof and issue a baggage identification tag for each piece of checked baggage.

9.4.3 Hebei Airlines shall enter the pieces and weight of any checked baggage in the proper column on the Passenger Ticket and Baggage Check.   

9.4.4 Checked baggage will be carried on the same aircraft as the passenger unless Hebei Airlines decides that this is impracticable, in which case Hebei Airlines will carry the checked baggage on Hebei Airlines next flight on which space is available.

9.4.5 For international and regional flights of Hebei Airlines excluding flights operating to or from the United States, each piece of checked baggage shall not exceed 32 kilograms. For flights operating to or from the United States, each piece of checked baggage shall not exceed 45 kilograms. Total dimensions (length + width + height) of each piece shall not exceed 300 cm. If a passenger wants to check a piece of baggage beyond 32 kilograms and up to 45 kilograms in weight and beyond 203 cm and up to 300 cm in total dimensions, he/she shall consult with Hebei Airlines ticket issuance office, fill in an application form and obtain consent from Hebei Airlines in advance.

9.5 Free baggage allowance

9.5.1 Free baggage allowance based on the piece concept applies to international and regional flights of Hebei Airlines.

9.5.2 Free baggage allowance based on the piece concept for flights between China and Europe/ Korea/Southeast Asia, and between Chinese mainland and Hong Kong/Macau/Taiwan Except as otherwise provided in Hebei Airlines Regulations, the free baggage allowance for each passenger will be limited as follows:

a) Free allowance for adults

A passenger paying applicable first class fare is entitled to a free baggage allowance of 3 pieces, of which the weight shall not exceed 32 kilograms for each piece. A passenger paying applicable business class fare is entitled to a free baggage allowance of 2 pieces, of which the weight shall not exceed 32 kilograms for each piece. A passenger paying applicable economy class fare is entitled to a free baggage allowance of 1 piece, of which the weight shall not exceed 23 kilograms. The maximum sum of three dimensions (length, width and height) of any piece in the above free baggage allowance shall not be more than 158cm;

b) Free allowance for children/infants

Children and infants paying the children’s fare are entitled to the same free baggage allowance as adult passengers. Infants paying 10% of the applicable fare are entitled to 1 piece, of which the weight shall not exceed 10 kilograms and the sum of three dimensions shall not exceed 115cm, plus one fully collapsible stroller or pushchair.

9.5.3 Free baggage allowance based on the piece concept for flights between China and Australia/ Canada/United States/Japan

Except as otherwise provided in Hebei Airlines Regulations, the free baggage allowance for each passenger will be limited as follows:

a) Free allowance for adults

A passenger paying applicable first class fare is entitled to a free baggage allowance of 3 pieces, of which the weight shall not exceed 32 kilograms for each piece. A passenger paying applicable business class fare is entitled to a free baggage allowance of 2 pieces, of which the weight shall not exceed 32 kilograms for each piece. A passenger paying applicable economy class fare is entitled to a free baggage allowance of 1 piece, of which the weight shall not exceed 23 kilograms. The maximum sum of three dimensions (length, width and height) of any piece in the above free baggage allowance shall not be more than 158cm;

b) Free allowance for children/infants

Children and infants paying the children’s fare are entitled to the same free baggage allowance as adult passengers. Infants paying 10% of the applicable fare are entitled to 1 piece, of which the weight shall not exceed 10 kilograms and the sum of three dimensions shall not exceed 115cm, plus one fully collapsible stroller or pushchair.

9.5.4 For through journeys where the passenger travels on combined class service, the free baggage allowance on each portion of travel shall be that applicable to the service for which the fare is paid in accordance with the piece concept.

9.5.5 Where two or more passengers, traveling as one party to a common destination or point of stopover by the same flight, present themselves and their baggage for travel at the same time and place, pooling of baggage will be permitted under either the weight or piece concept.

9.5.6 Where voluntary reroutings are made, a passenger shall be entitled to the free baggage allowance appropriate to the class of service for the rerouted portion. Where involuntary reroutings are made, a passenger shall be entitled to the free baggage allowance applicable to the fare originally paid.

9.6 Excess baggage

9.6.1 Excess baggage means the baggage to be carried in excess of the free baggage allowance for checked and unchecked baggage.

9.6.2 Hebei Airlines will provide carriage of excess baggage only to the passenger who has paid the excess baggage charge and for which the excess baggage ticket has been issued.

9.6.3 A passenger shall pay the excess baggage charge at the rate and in the manner provided in Hebei Airlines Regulations.

 

9.7 Excess value declaration and charge

9.7.1 A passenger may declare a value for checked baggage in excess of USD20 (or its equivalent) per kilogram.

9.7.2 When such a declaration is made, the excess value charge shall be at the rate of 5‰ of such excess value as described in Para 9.7.1.

9.7.3 No baggage of each passenger will be accepted for carriage by Hebei Airlines if the declared value is in excess of USD2,500(or its equivalent).

9.7.4 Hebei Airlines will refuse to accept an excess value declaration on checked baggage when a portion of the carriage is to be provided by another carrier which does not offer the facility.

9.8 Unchecked baggage

9.8.1 Unchecked baggage must fit under the seat in front of the passenger or in an enclosed storage compartment in the cabin with maximum dimensions not exceeding 20cmx35cmx55cm.

9.8.2 Unchecked baggage comprises free carry-on items and cabin baggage.

9.8.3 Free carry-on items

9.8.3.1 According to Hebei Airlines Regulations, on international and regional flights of Hebei Airlines, each first class passenger may carry 1 or 2 items for use during the trip without additional charge; each business/economy class passenger may carry 1 item for use during the trip without additional charge. The weight of each item shall not exceed 5 kilograms. The infant not occupying a passenger seat has no free allowance for carry-on items.

9.8.3.2 No baggage tag shall be attached to the free carry-on items.

9.8.4 Cabin baggage

9.8.4.1 Objects not suitable for carriage in the cargo compartment will only be accepted as cabin baggage,if prior permission has been granted by Hebei Airlines.

9.8.4.2 Cabin baggage shall be weighed and counted towards the free baggage allowance.

9.8.4.3 A baggage tag shall be issued for each piece of cabin baggage.

9.8.4.4 The carriage of cabin baggage may be charged separately.  

9.9 Collection and delivery of baggage

9.9.1 The passenger shall collect his or her baggage as soon as it is available for collection at places of destination or stopover.

9.9.2 Only the bearer of the baggage check and identification tag, delivered to the passenger at the time the baggage was checked, is entitled to delivery of baggage. Failure to exhibit the baggage identification tag shall not prevent delivery provided the baggage check is produced and the baggage is identified by other means.

9.9.3 If a person claiming the baggage is unable to produce the baggage check and identify the baggage by means of a baggage identification tag, Hebei Airlines will deliver the baggage to such person only on condition that he or she establishes to Hebei Airlines satisfaction his or her right thereto, and if required by Hebei Airlines, such person shall fill in such application form as prescribed by Hebei Airlines, furnishing adequate security to indemnify Hebei Airlines for any damage or expense which may be incurred by Hebei Airlines as a result of such delivery.

10 Schedules, cancellation and change of flights

10.1 Hebei Airlines undertakes to use its best efforts to carry the passenger and his baggage with reasonable dispatch and to adhere to the schedule in effect on the date of travel.

10.2 Cancellation and change of flights

10.2.1 When circumstances so require, Hebei Airlines may, without prior notice,change aircraft type, divert, cancel, terminate, postpone, or delay any flight:

a) in order to comply with any applicable laws, regulations or orders of any state to be flown from, to or over; or

b) in order to assure safe operation of a flight; or

c) circumstances beyond the control and prediction of Hebei Airlines.

10.2.2 If due to circumstances listed in Para 10.2.1, Hebei Airlines cancels a flight, fails/delays to operate reasonably according to schedules, is unable to provide previously confirmed space, causes a passenger to miss a connecting flight on which the passenger holds a reservation, Hebei Airlines, with due consideration to the passenger’s reasonable requirement, shall either:

a) carry the passenger on another of its scheduled passenger services on which space is available; or

b) reroute the passenger to the destination indicated on the ticket or applicable portion thereof by its own scheduled services or the scheduled services of another carrier, or by means of surface transportation. If the sum of the fare, excess baggage charge and applicable service charge for the revised routing is higher than the refund value of the ticket or applicable portion thereof, Hebei Airlines shall require no additional fare or charge from the passenger and shall refund the difference if the fare and charges for the revised routing are lower; or.

c) make a refund subject to regulations specified in Para 11.4 “Involuntary refund”;

d) help passengers arrange accommodations, surface transportation and other service.

10.2.3 If due to circumstances on the fault of Hebei Airlines, Hebei Airlines cancels or delays any flight, is unable to provide previously confirmed space, causes a passenger to miss a connecting flight on which the passenger holds a reservation, fails to stop at the point of destination or stopover point, Hebei Airlines shall make arrangements in accordance with regulations specified in item a), b), c) of Para 1.2.2 and provide resting place, beverages, foods, accommodations and other appropriate services free of charge.

10.2.4 Except in the case of its acts or omissions done with intent to cause damage or recklessly and with knowledge that damage would probably result, Hebei Airlines shall not be liable for errors or omissions in timetables or other published schedules, or for representations made by employees, agents or representatives of Hebei Airlines as to the dates or times of departure or arrival or as to the operation of any flight.

11 Refunds

11.1 On failure by Hebei Airlines to provide carriage in accordance with the contract of carriage, or where a passenger requests a voluntary change of his or her arrangements, refund for an unused ticket or portion thereof shall be made by Hebei Airlines in accordance withthis paragraph and Hebei Airlines Regulations.

11.2 Passenger requesting refund shall submit refund applicationin accordance withHebei Airlines regulations.

11.3 Person to whom refund will be made

11.3.1 Except as hereinafter provided in this paragraph, Hebei Airlines shall be entitled to make a refund either to the person named in the ticket, or to the person who has paid for the ticket upon presentation of satisfactory proof.

11.3.2 If a ticket has been paid for by a person other than the passenger named in the ticket, and Hebei Airlines has indicated on the ticket that there is a restriction on refund, Hebei Airlines shall make a refund only to the person paying for the ticket or to that person's order.

11.3.3 Except in the case of lost tickets, refunds will only be made on surrender to Hebei Airlines of the passenger coupon or passenger receipt and surrender of all unused flight coupons.

11.3.4 A refund made to anyone presenting the passenger coupon or passenger receipt and all unused flight coupons and holding himself or herself out as a person to whom refund may be made in terms of Para 11.3.1 or Para 11.3.2 shall be deemed a proper refund to such person and shall discharge Hebei Airlines from liability and any further claim for refund.

11.4 Involuntary refund may be made ifHebei Airlines cancels a flight, fails to operate a flight reasonably according to schedule, fails to stop at a point to which the passenger is destined or ticketed to stopover, is unable to provide confirmed space or causes the passenger to miss a connection flight on which the passenger holds a reservation.The amount of the refund shall be:

11.4.1 If no portion of the ticket has been used, an amount equal to the fare paid;

11.4.2 If a portion of the ticket has been used, the refund will be the higher of the one way fare (less applicable discounts and charges) from point of interruption to destination or point of next stopover and the difference between the fare paid and the fare for the transportation used.

11.5 Voluntary refund may be made if the passenger wishes a refund of his or her ticket for reasons other than those set out in Para 11.4. The amount of the refund shall be:

11.5.1 If no portion of the ticket has been used, an amount equal to the fare paid, less any applicable service charges or cancellation fees;

11.5.2 If a portion of the ticket has been used, any refund will be an amount equal to the difference between the fare paid and the applicable fare for travel between the points for which the ticket has been used, less any applicable service charges or cancellation fees.

11.6 Refund on lost ticket

11.6.1 If a ticket or portion thereof is lost, refund will be made within thirty (30) days after the expiration of the ticket on proof of loss satisfactory to Hebei Airlines and upon payment of any applicable service charge, on conditionthat the person to whom the refund is made undertakes, in such form as may be prescribed by Hebei Airlines, to repay to Hebei Airlines the amount refunded in the event and to the extent that the lost ticket or portion thereof is used by any person or that refund thereof is made to any person in possession of the ticket.

11.6.2 Refund on lost ticket shall be made in accordance with regulations specified in Para 11.5 “Voluntary refund”.

11.7 Right to refuse refund

11.7.1 Hebei Airlines may refuse refund when application therefore is made later than thirty (30) days after the expiry of the validity of the ticket.

11.7.2 Hebei Airlines may refuse refund on a ticket which has been presented to Hebei Airlines or to government official of a country as evidence of intention to depart there from, unless the passenger establishes to Hebei Airlines satisfaction that he or she will depart there from by another carrier or another means of transport.

11.8 All refunds will be made subject to government laws, rules and regulations or orders of the country on which the ticket was originally purchased and of the country in which the refund is being made. Subject to the foregoing provision, refunds will normally be made in the currency in which the ticket was paid for, or, at the option of Hebei Airlines, in the currency specified by Hebei Airlines.

11.9 Refund will be made only by Hebei Airlines or its authorized agent at the original issue place or at the place agreed by Hebei Airlines.

12 International passenger service

12.1 Except as otherwise provided in Hebei Airlines regulations, the meal served in the aircraft shall be provided by Hebei Airlines, but Hebei Airlines cannot guarantee the types and quantities other than those specified in its regulations.

12.2 If in the course of concluding the contract of carriage by air, Hebei Airlines also agrees to make arrangements for the provision of additional services.Hebei Airlines shall have no liability to the passenger except for negligence on its part in making such an arrangement.

13 Conducts aboard the aircraft

13.1 If a passenger conducts himself or herself aboard the aircraft in a manner that endangers the aircraft or any person or property on board, or obstructs the crew in the performance of their duties, or fails to comply with any instruction of the crew, or behaves in a manner to which other passengers may reasonably object, Hebei Airlines may take such measures as it deems necessary to prevent continuation of such conduct, including restraint of the passenger.

13.2 The passengers may not operate aboard the aircraft portable radios, recorders, mobile phones, electronic games or transmitting devices including radio controlled toys and walkie-talkies. The passengers shall not operate any other electronic devices on board without Hebei Airlines permission, except that hearing aids and heart pacemakers may be used.

14 Administrative formalities

14.1 The passenger shall be solely responsible for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, to or over, and with Hebei Airlines regulations and instructions. Hebei Airlines shall not be liable for any aid or information given by any agent or employee of Hebei Airlines to any passenger in connection with obtaining necessary documents or visas or complying with such laws, regulations, orders, demands and requirements, whether given in writing or otherwise; or for the consequences to any passenger resulting from his failure to obtain such documents or visas or to comply with such laws, regulation, orders, demands, requirements, rules or instructions.

14.2 The passenger shall present all exit, entry, health and other documents required by laws, regulations, orders, demands or requirements of the countries concerned. Hebei Airlines reserves the right to refuse carriage of any passenger who has not complied with applicable laws, regulation, orders, demands or requirements or whose documents do not appear to be in order.

14.3 Subject to applicable laws and regulations, the passenger agrees to pay the applicable fare whenever Hebei Airlines, on government order, is required to return a passenger to his point of origin or elsewhere, owing to the passenger's inadmissibility into a country, whether of transit or of destination. Hebei Airlines may apply to the payment of such fare any funds paid to Hebei Airlines for unused carriage, or any funds of the passenger in the possession of Hebei Airlines. The fare collected for carriage to the point of refusal of entry or deportation will not be refunded by Hebei Airlines.

14.4 If Hebei Airlines is required to pay or deposit any fine or penalty or to incur any expenditure by reason of the passenger's failure to comply with laws, regulations, orders, demands and travel requirements of the countries concerned or to produce the required documents, the passenger shall on demand reimburse to Hebei Airlines any amount so paid or deposited and any expenditure so incurred. Hebei Airlines may use towards such expenditure any funds paid to Hebei Airlines for unused carriage, or any fund of the passenger in his possession of Hebei Airlines.

14.5 If required, the passenger shall attend inspection of his baggage, checked or unchecked, by customs or other government officials. Hebei Airlines is not liable to the passenger for any loss or damage suffered by the passenger through failure to comply with these requirements.

14.6 The passenger shallobserve all provisions of laws, regulations, orders, demands and travel requirements of the countries concerned during the carriage, and submit to any security checks by government or airport official or by Hebei Airlines.

15 Liability for damage

15.1 Carriage to be performed by several successive air carriers under one ticket, or under a ticket and any conjunction ticket issued in connection therewith, is regarded as a single operation.

15.2 International carriage herein conducted by Hebei Airlines is subject to the rules and limitations relating to liability established by the Convention unless such carriage is international carriage to which the Convention does not apply. Applicability of liability limit for damage in the Convention is as follows:

a) If the carriage falls into “international carriage” prescribed by the Montreal Convention, the liability limit for damage in the Montreal Convention applies.

b) If the carriage falls into “international carriage” prescribed by the Warsaw Convention or Hague Protocol but not by the Montreal Convention, the liability limit for damage in the Warsaw Convention or Hague Protocol applies.

15.3 Liability limit for damage in the Convention

15.3.1 The Warsaw Convention or Hague Protocol

a) In the international carriage to which the Warsaw Convention applies, the liability of Hebei Airlines in the case of death or injury of passengers is limited to the sum of 125,000 Gold Francs or its equivalent. In the international carriage to which the Hague Protocol applies, the liability of Hebei Airlines in the case of death or injury of passengers is limited to the sum of 250,000 Gold Francs or its equivalent.

b)  The liability of Hebei Airlines in the case of damage to checked baggage is limited to the sum of 250 Gold Francs or its equivalent per kilogram and in the case of damage to unchecked baggage and passenger carry-on items is limited to the sum of 5,000 Gold Francs or its equivalent per passenger. If the weight of the baggage is not recorded on the baggage check, it is presumed that the total weight of the checked baggage does not exceed the applicable free baggage allowance for the class of service concerned. If a value declaration is made for the checked baggage according to 56F02-5 Para 7 the liability of Hebei Airlines is limited to such declared value.

15.3.2 The Montreal Convention

a) The liability of Hebei Airlines in the case of death or injury of passengers is limited to the sum of 113,100 Special Drawing Rights per passenger, to which Article 20 and paragraph 1 of Article 21 in the Montreal Convention apply.

b) The liability of Hebei Airlines in the case of damage occasioned by delay in the carriage by air is limited to the sum of 4,694 Special Drawing Rights or its equivalent per passenger. Nevertheless, Hebei Airlines shall not be liable for damage occasioned by delay if it proves that it and its servants and agents took all measures that could reasonably be required to avoid the damage or that it was impossible for it or them to take such measures.

c) The liability of Hebei Airlines in the case of damage to baggage (including checked baggage and unchecked baggage) is limited to the sum of 1,131 Special Drawing Rights or its equivalent per passenger. If a value declaration is made for the checked baggage according to 56F02-5 Para 7 the liability of Hebei Airlines is limited to such declared value.

15.4 In the international carriage to which the Convention does not apply:

a) Hebei Airlines shall be liable for damage to a passenger or his checked baggage only if it is proved that the damage resulted from an act or omission of Hebei Airlines, done with intent to cause damage or recklessly and with knowledge that damage would probably result. If the damage was caused or contributed to by the negligence of the passenger, Hebei Airlines shall be wholly or partly exonerated from its liability for damage in accordance with applicable laws and regulations.

b) In the case of an act or omission of Hebei Airlines, done with intent to cause damage or recklessly and with knowledge that damage would probably result, the liability of Hebei Airlines in respect to each passenger for death, wounding or other bodily injury shall be limited to the sum of 113,100 Special Drawing Rights or its equivalent.

c) In the case of an act or omission of Hebei Airlines, done with intent to cause damage or recklessly and with knowledge that damage would probably result, the liability of Hebei Airlines in respect to baggage (including checked baggage and unchecked baggage) is limited to the sum of 1,131 Special Drawing Rights or its equivalent. If a value declaration is made for the checked baggage according to 56F02-5 Para 7 the liability of Hebei Airlines is limited to such declared value.

15.5 To the extent not in conflict with the foregoing and whether or not the Convention applies:

15.5.1 Hebei Airlines is liable only for damage occurring on its own flights. If Hebei Airlines, as an agent, issues a ticket or checks baggage for carriage (including code-share flights) of another carrier, the passengers only have right to bring an action against the first or last carrier. If change, delay, cancellation, overbooking of the flight, damage or loss of the baggage, personal injury and other situations occur on the flight that is not conducted by Hebei Airlines (including code-share flight), the operating carrier shall be liable for the compensation and Hebei Airlines may assist in contacting the operating carrier.

15.5.2 Hebei Airlines shall not be liable for any damage arising from its compliance with any laws or government regulations, orders or requirements, or from failure of the passenger to comply with the same.

15.5.3 If the weight of the baggage is not recorded on the baggage check, it is presumed that the total weight of the checked baggage does not exceed the applicable free baggage allowance for the class of service concerned. If a higher value is declared for the checked baggage, the liability of Hebei Airlines shall be limited to such higher declared value.

15.5.4 Hebei Airlines liability shall not exceed the amount of proven damages. Hebei Airlines shall furthermore not be liable for indirect or consequential damages.

15.5.5 Hebei Airlines is not liable for injury to a passenger or for damage to a passenger’s baggage caused by property contained in the passenger’s baggage. Any passenger whose property causes injury to another person or damage to another person’s property or to the property of Hebei Airlines shall indemnify Hebei Airlines for all losses and expenses incurred by Hebei Airlines as a result thereof.

15.5.6 Hebei Airlines is not liable for damage to fragile or perishable articles, money, jewelry, silverware, negotiable papers, securities, or other valuables, business documents, passports and other identification documents, or samples, which are included in the passenger’s checked baggage. Hebei Airlines liability for the aforementioned will be the same as ordinary checked baggage.

15.5.7 If a passenger is carried whose age or mental or physical condition is such as to involve any hazard or risk to himself or herself, Hebei Airlines shall not be liable for any illness, injury or disability, including death, attributable to such condition or for the aggravation of such condition.

15.5.8 Any exclusion or limitation of liability of Hebei Airlines shall apply to and be for the benefit of agents, employees and representatives of Hebei Airlines and any person whose aircraft is used by Hebei Airlines and such person’s agent, employees and representatives. The aggregate amount recoverable from Hebei Airlines and from such agents, employees, representatives and person shall not exceed the amount of Hebei Airlines limit of liability.

15.5.9 Unless so expressly provided nothing herein contained shall waive any exclusion or limitation of liability of Hebei Airlines under the Convention or applicable laws.

16 Time limits for complaints

16.1  Acceptance of baggage by the bearer of the baggage check without complaint at the time of delivery is prima facie evidence that the baggage has been delivered in good condition and in accordance with the contract of carriage, unless the passenger proves otherwise.

16.2 In the case of damage, the person entitled to delivery must complain in writing to Hebei Airlines forthwith after the discovery of the damage, and, at the latest, within seven days from the date of receipt of the checked baggage. In the case of delay, the complaint must be made in writing at the latest within twenty-one days from the date on which the baggage has been placed at his/her disposal.

16.3 If Hebei Airlines admits the loss of the checked baggage, or if the checked baggage has not arrived at the expiration of twenty-one days after the date on which it ought to have arrived, the passenger is entitled to enforce against the carrier the rights which flow from the contract of carriage.

The right to damages shall be extinguished if an action is not brought within a period of two years, reckoned from the date on which the aircraft ought to have arrived, or from the date of arrival at the destination, or from the date on which the carriage stopped.

17 Effectiveness and modification

17.1 These Conditions of Carriage shall become effective as of the date on Apr. 20th, 2016.

17.2 Hebei Airlines has the right to modify its Conditions of Carriage, regulations, fares, and charges in accordance with the procedures of the Civil Aviation Administration of China without notice. The conditions modified do not apply for the carriage undertaken before the modification.

17.3 No agent, employee or representative of the carrier has authority to alter, modify or waive any provision of these Conditions of Carriage.
